Analysis of the International Food Defense Regulation and the factors that influence compliance decision: the case of selected fish processing firms in Mindanao, Philippines

Abstract

The threat of bioterrorism has pushed for the increasing effort to protect the global food supply against intentional contamination. The U.S. Food Safety Modernization Act (FSMA) is the first legislation in history to provide for Food defense against intentional food contamination. The Food Defense final rule mandatorily requires all food companies from different countries trading with the U.S. to comply with the new rule. Contextual geophysical and community attributes are assumed to shape the extent to which internal or external factors influence the organization's compliance decision. This dissertation analyzed these factors taking the context of the fish processing industry in Mindanao. Analytical methods include comparative law analysis, case studies, and KAP survey. Results revealed that FSMA was comprehensively designed in both structure and function to effectively implement total food protection. Compared to FSMA, the Philippine Food Safety Act fell short of its provisions to consider intentional contamination. Government intervention, private enforcement, regulatory knowledge and regulatory focus are the factors that influence food defense compliance decision of the fish processing firms in Mindanao. Regulatory knowledge was the main factor in compliance decision among others. Therefore, to encourage compliance decision with food defense, strategies and actions that will promote knowledge development should be prioritized in policy making and be the first to be implemented.
